With its recent decision of 15 March 2022, the Federal Fiscal Court (Bundesfinanzhof, BFH) follows the decision of the Federal Supreme Court (Bundesgerichtshof, BGH) that so-called "cum-ex transactions" are to be considered tax evasion under criminal law.
In the course of the COVID 19 pandemic, numerous restaurants and hotels in particular were affected by officially ordered business closures. Until now, the question of whether a business closure or business interruption insurance policy covers the resulting damage has been unresolved.
