BGH: Business closure insurance does not pay in case of COVID-19

In the course of the COVID 19 pandemic, numerous restaurants and hotels in particular were affected by officially ordered business closures. Until now, the question of whether a business closure or business interruption insurance policy covers the resulting damage has been unresolved. The higher courts have judged this question differently in various decisions. In most cases, it was based on whether the insurance conditions listed specific diseases or made general reference to the Infection Protection Act (IfSG), in which SARS-CoV-2 was not mentioned at the beginning of the pandemic.

New BGH ruling on corona-related business closures

On 12 January 2022, the XII Senate of the Federal Supreme Court (BGH) handed down a landmark decision on the effects of officially ordered shop closures on commercial leases. Particularly important is the Federal Supreme Court's finding that an officially decreed general business closure due to the COVID 19 pandemic regularly does not constitute a defect of the rental object within the meaning of Section 536 (1) 1 of the German Civil Code (BGB).

The next step towards "Corporate Criminal Law"

As many are aware, the draft of the so-called Association Sanctions Act ("VerSanG"), which is sometimes called the "small business criminal law", has been circulating since 15 August 2019. In terms of content, it concerns the possibility of sanctioning companies and other associations if criminal offences are committed from their sphere. There were positive voices on this draft, but also quite a few critical ones.
